???? 6 months in prison for filming in the national parks?

In this video we discusses a recent rule change that affects the use of cameras and filming equipment in US National Parks and other federally-owned lands. The change states that any video activity on these lands is now deemed commercial unless it is for personal use. This means that creators on platforms such as YouTube, TikTok, and Instagram can now face fines and possible jail time for filming and uploading footage without a permit. I Applied for National Park Filming Permits, Here's What Happened

This is my experience applying for filming permits to record video in National Parks and post the content on YouTube. The First Amendment to the Constitution guaranteeing freedom of speech and freedom of the press should protect us from unreasonable permit and fee requirements when visiting public lands.

Detailed Description of Onsite Activities (from my permit application):
A single vehicle will use regular park roads and parking lots. Filming locations will be limited to marked trails and other outdoor spaces which are specifically shown on National Park Service maps obtained at the park Visitors Center, and will be selected on the day of arrival based on favorable weather and trail conditions. Locations will be accessed by a single photographer on foot carrying only a daypack, including one iPhone, one GoPro, and a compact tripod. None of the photographer’s vehicle, equipment, or clothing will include any advertising or marketing, and the photographer’s activity in the park will be indistinguishable from an ordinary park visitor. Filmed footage will consist of park scenery and the photographer speaking to the camera. The purpose of the project is for posting a brief video of personal travels on social media, such as YouTube. The requested use is an exercise of a First Amendment right, and therefore no fee is included.

National Park Service Response (all 7 parks had the same response):
Dear __________,
We have received your application for a Special Use Permit for Commercial Filming/Still Photography at __________ National Park. Based upon the description of the activities provided in your permit application, it does not appear that they would constitute commercial filming under federal law. As a result, you are not required to obtain a special use permit for commercial filming or pay associated fees. You are responsible for securing any necessary permissions or releases if you will be filming other people in the park. In addition, all filmers must comply with regulations that apply in the park, just like other visitors.  Thank you for your interest in visiting __________ National Park. We hope you enjoy your time in the park.

Social Media in a National Park is now A Federal Offense- without a permit! Explained

The National Park Service won an appeal by 3-2 to require Filming Permits and Photo permits in all NPS properties when the Creator has a Monetized account. If it generates revenue it requires a permit. Social Media Companies generate revenue so does that mean every poster needs a Permit- COULD BE! It's a very poorly worded law that was written years before Social Media became a thing. The Law needs to change for this modern era so our kids are not prosecuted for a Federal Criminal Offense.

National Parks Cancel Freedom of Speech for YouTubers

Park Junkie would love to say its all fun and games out there in our parks and public lands... But at the end of the day, these are lands that are administered by the Federal Government. A recent ruling handed down by a Federal Court demonstrates that the fight for public access and freedoms on these lands is never without challenge.

This story involves the First Amendment rights of Free Speech and Freedom of the Press that the National Park Service has moved to suspend from public lands with their recent restructuring of Commercial Filming requirements.

The case of Price v. Barr involves an independent filmmaker named Gordon Price, who was given a citation for filming parts of his Crawford Road film in Colonial National Historic Park, near Yorktown, Virginia. Mr Price challenged the NPS on First Amendment grounds and won an initial case in 2021. However, the NPS appealed the case and a Federal Appeals court sided with the Government in late August of 2022.

The NPS subsequently updated their commercial filming regulations to EXPLICITLY name YouTubers and TikTokers among those who now must obtain a commercial film permit on NPS land.

My experience trying to get a National Parks Filming Permit

Planning a trip this summer to a national park? Want to make a video of your adventure and share it with the world? Make sure you apply for a permit to film before you go! After a recent ruling, it was decided to include all YouTube, TikTok, and other social media platforms where people film and make money must have a permit. Many YouTubers have covered this (and the absolute ludicrousness of it), but what is also so frustrating is how complicated the whole process of actually getting a permit is and that it’s seriously a 4th amendment right issue!

This rule is a big problem for full-time RV travellers and vloggers like myself who love to share our adventures with the world.

Changes to Free NPS Entrance, YouTubers Fined, Longest Fossilized Prints Found | National Park News

The world's longest fossilized footprint tracks have been uncovered in the White Sands of New Mexico, the National Trail system has grown by more than 1,300 miles, two YouTubers are fined $1,000, a hiker lost in Zion for 12 days has been found, but questions abound about her disappearance, and a big change in policy will allow America’s more than 20 million veterans access to National Parks for free.
